Terms and conditions

Version 2026-10 — applicable from October 2026

1. Who we are

CarCentrale is an online vehicle marketplace operated by SMART BOUW BV, Statiestraat 31, 2070 Zwijndrecht, company number BE0800.306.022 ("CarCentrale", "we"). Contact: smartbouwbv@gmail.com.

2. Our service

On CarCentrale, sellers (private individuals and dealers) publish vehicle listings and buyers can browse them and contact the seller. CarCentrale acts solely as an intermediary within the meaning of the Digital Services Act: we are not a party to the sales contract, do not sell or inspect vehicles and do not collect payments between buyer and seller. The sales contract is concluded directly between buyer and seller.

3. Account

  • You need an account to list a vehicle or contact sellers. You must be at least 18 years old and legally competent.
  • You provide accurate and complete information and keep it up to date. You confirm your e-mail address.
  • You are responsible for keeping your password confidential and for all activity through your account. One person or company = one account.
  • Dealers (anyone selling vehicles in the course of business) must use a dealer account and provide their company name, company number, address and phone number. These details are shown with their listings (Art. 30–31 DSA). Selling professionally through a private account breaches these terms.

4. Listing rules

As a seller you declare and warrant that:

  • you own the vehicle or are expressly authorised to sell it, and the vehicle is actually available;
  • all information (including year, mileage, damage, history and price) is accurate, complete and not misleading;
  • the photos show the vehicle offered and you hold the rights to them;
  • when selling in Belgium you comply with all legal obligations, including handing over a valid Car-Pass certificate and applicable consumer protection law (for dealers: e.g. displaying prices including VAT and the statutory guarantee).

It is prohibited to:

  • offer stolen vehicles, vehicles with forged documents or a tampered odometer;
  • post false, bait or fictitious listings, or list the same vehicle more than once;
  • include links, e-mail addresses or payment instructions in listings, or ask buyers for deposits, gift cards, cryptocurrency or money-transfer payments;
  • post content that is illegal, discriminatory, offensive or sexual, or advertising for gambling, casinos or other services;
  • collect other users' data, automatically extract content from the platform (scraping) or disrupt its operation;
  • send unsolicited advertising messages (spam).

A listing stays online for 60 days and can be renewed free of charge. Private sellers can have up to 5 listings online at the same time.

5. Checks and moderation

To protect buyers, we automatically check listings for known fraud indicators (e.g. a suspiciously low price or payment instructions). Flagged listings are only published after a manual review by a staff member. No decisions with legal effect are taken solely by automated means.

We may refuse, take offline or remove a listing, or temporarily or permanently block an account, if the listing or conduct breaches the law or these terms. You will then receive a reasoned decision stating the reason, the facts and your options to appeal (Art. 17 DSA). Our measures are proportionate; in case of serious or repeated breaches (e.g. fraud) an account may be blocked immediately. Where we suspect a criminal offence threatening anyone's life or safety, we inform the competent authorities (Art. 18 DSA).

More information: Reports & moderation.

6. Reporting illegal content

Anyone can report content that is illegal or breaches these terms using the "Report this listing" button on each listing. We handle reports in a timely, diligent and objective manner and inform the reporter of our decision.

7. Prices

CarCentrale is currently free for buyers and sellers. We may introduce paid options or fees in the future (e.g. for dealers or extra visibility). These will be announced at least 30 days in advance; you never pay without your explicit consent and existing free listings never become paid automatically.

8. Contact between users

Buyer messages are forwarded to the seller by e-mail, together with the buyer's name and e-mail address. Use these details only to complete the sale. We recommend never paying in advance without having seen the vehicle and documents (see Buy safely).

9. Content and licence

You remain the owner of the texts and photos you post. You grant CarCentrale a non-exclusive, royalty-free licence to store, adapt (e.g. resize) and display this content on the platform and in promoting your listing (e.g. sharing on social media or in search alerts) for as long as the listing is online.

10. Liability

CarCentrale provides its service with the utmost care but cannot guarantee that the platform will always work without interruption or errors. We are not liable for the content of listings, the condition or ownership of vehicles, or the performance of sales contracts between users, except in case of our own wilful misconduct or gross negligence and without prejudice to mandatory law. You indemnify CarCentrale against third-party claims arising from your breach of these terms or the law.

11. Appeals and complaints

Disagree with a decision about your listing, account or report? File a complaint within 6 months by replying to our e-mail or via smartbouwbv@gmail.com. A staff member will review the decision. You can also use a certified out-of-court dispute settlement body or go to court. Consumers can contact the Belgian Consumer Mediation Service.

12. Termination

You can delete your account at any time in "Settings". We may terminate this agreement in case of serious or repeated breaches, or with 30 days' notice if we discontinue the service.

13. Changes

We may amend these terms, for example due to new legislation or features. Material changes are announced by e-mail at least 30 days in advance. If you continue to use CarCentrale, you accept the new terms; if not, you can delete your account free of charge.

14. Governing law

These terms are governed by Belgian law. Disputes fall under the jurisdiction of the courts of Antwerp, Antwerp division, without prejudice to mandatory jurisdiction rules protecting consumers. In case of discrepancy between language versions, the Dutch version prevails unless mandatory law provides otherwise.
